Einhorn's
defense attorneys moved, during the pre-trial, to declare a new trial
unconstitutional under the grounds that it was granted to appease the
French government and ensure Einhorn's extradition. Judge William
Mazolla denied that motion. Mazzola pointed out that
Einhorn has repeatedly professed his desire to prove his innocence in
court and that by requesting a new trial waived his right to denounce that
process.
